The Town of Scarsdale

The Town of Scarsdale has a population of approximately 17,000 residents based on the U.S. Census of 2010. The Town was named in the early 1700’s by the son of Charles the 2nd, and the English name Scarsdale means “dale of scars of rocks.” Scarsdale became a town on March 7, 1788. During the American Revolution, the British and Colonial armies were briefly in the town, and there was a short battle near the intersection of Garden and Mamaroneck Roads. The Bronx River Parkway, which was the first parkway in the United States, opened in Scarsdale in 1924.

There are several major roadways which run through the Town, including the Hutchinson River Parkway, Bronx River Parkway, and local roadways such as Post Road (Route 22), Weaver Street and Fenimore Road.

For the last twenty six years, The Law Office of Mark A. Speeding tickets are one of the most serious traffic infractions and are a large percentage of the traffic calendar in local courts such as the Village of Scarsdale Court. Village and Town Court justices are reluctant to permit a plea bargain of a speeding ticket to another moving violation or to a non moving violation if the charge is for more than 25-30 miles per hour over the speed limit. Additionally, the Scarsdale Village justices are tough on speeding in construction zone or school zones. However, we have successful in obtaining favorable sentences even with these infractions, particularly if the driver has an otherwise “clean” driving record and has no other tickets within an eighteen month period.

If you receive and are convicted of two speeding tickets in an eighteen month period for traveling 21-30 miles an hour over the posted speed limit, this can quickly result in a suspension of your driver’s license, as you would have 12 points on your driver’s license. 11 points assessed against the driver’s license within an eighteen month period results in a suspension of the driver’s license. Further, if you receive 6 points on your operator’s license in 18 months, this results in a “Driver’s Responsibility Assessment”, which is a fine imposed by the Department of Motor Vehicles. The fine is $300.00, which can be paid in three yearly installments of $100.00, or in one payment. Driver’s Responsibility Assessments are also issued in every DWI case, in the amount of $750.00, which can be paid in three yearly installments of $250.00, or in one payment.

Our office has successfully represented clients in the Scarsdale Village Court in a variety of criminal cases and traffic violations. In DWI cases, we have obtained several favorable resolutions of cases and hardship privileges, conditional licenses, and conditional discharges in numerous cases. In traffic matters, we have obtained reduced fines, reduced points, and in many instances have secured no point resolutions for our clients.

The Scarsdale Village Court handles all traffic infractions, parking tickets, civil cases, and criminal cases (not felonies, which are handled in the Westchester County Court), as well as small claims cases.

SCHEDULE FOR THE SCARSDALE VILLAGE COURT

The Scarsdale Village Court has a traffic and criminal calendar every Wednesday beginning at 9:00 AM. Traffic trials are generally conducted from approximately 1:00 PM to 5:00 PM on Wednesdays. The Small Claims calendar is the 2nd Thursday of each month.

DIRECTIONS TO THE SCARSDALE VILLAGE COURT

From the Bronx River Parkway (North/South):

Exit at the Crane Road. Travel east on Crane Road, and proceed through one traffic light. Just before the second traffic light at the intersection with Route 22, turn right into the into the Village Hall parking lot.

From Hutchinson River Parkway (North)

Get off at exit 22. At end of the ramp, make a right onto Mamaroneck Road. Remain on Mamaroneck Road for approximately two miles (through four traffic lights) until you reach Route 22–Post Road. At the light turn left onto Post Road. Travel through five lights. At the sixth light, make a right turn onto Crane Road and an immediate left into the Village Hall parking lot.

From Hutchinson River Parkway (South)

Get off at exit 21 (Weaver Street). At the end of the exit ramp, make a right turn. Stay on Weaver Street for three lights. At fourth light (known as the “Five Corners”), turn 45 degree to the left onto Heathcote Road. Stay on Heathcote Road until the intersection with Route 22 (Post Road). You will see the Court building in front of you. Cross Post Road and immediately turn left into the Village Hall parking lot.

Parking For the Scarsdale Village Court

Parking for the Scarsdale Village Court is not a problem. There is a large parking lot for the Village Hall and Village Court behind the Court building, which can be accessed from Crane Road. I have never had a problem finding a parking spot immediately in the Scarsdale Village Court parking lot, unlike many other courts in Westchester County.
